Investigating random homicides involves constructing models of an odd sort. While the differences between these models and scientific models are radical, calling them models is justified both by functional and structural similarities. Serial homicide investigations illustrate the marked difference between theoretical models in science and the models applied in these criminal investigations. This is further illustrated by considering Glymourian bootstrapping in attempts to solve such homicides. The solutions that result differ radically from explanations in science that are confirmed or disconfirmed (...) by occurrences. Unlike the scientist, the flatfoot gumshoe is also barefoot: he is bereft of a general, determinative theoretical frame. This result shows that criminal investigations do not apply science in the Galilean sense. (shrink)

Introduction: Emotional fluctuations and mood swings are common among adults with Attention Deficit/Hyperactivity Disorder. Here we investigated if these problems could be retrospectively traced back to childhood behavior.Methods: Adults with an ADHD diagnosis and a population-based control sample completed the Adult ADHD Self-report Scale, the Wender Utah Rating Scale and the Mood Disorder Questionnaire. All participants also provided self-reported information about co-existent psychiatric and somatic diseases, and demographic data. Reports on the MDQ were used to define subgroups with [MDQ] and (...) without [MDQ] life-time periods of emotional fluctuations and the WURS scale was used to retrospectively assess childhood ADHD related behaviors and symptoms.Results: 50.2% of the ADHD group and 5% of the controls were defined with emotional fluctuations [MDQ]. Childhood behavior ratings of “impulsivity,” “loosing of control,” and “trouble with authorities” independently predicted emotional fluctuations reported in adulthood via logistic regression analyses. Inclusion of these three items in a classification analysis gave an accuracy score around 70% in identifying each of the two MDQ categories in the ADHD group.Discussion: The strong association between self-reported features of emotional problems in childhood and in adulthood suggests a trajectory that should be detected and remediated at an early age. Future longitudinal studies should prioritize the examination of developmental mechanisms explaining the persistence of emotional problems from childhood into adulthood. (shrink)

Does environmental management help foreign firms outperform local firms in emerging economies? While existing research suggests that environmental management may or may not benefit firm performance, the question is particularly under-investigated in the emerging economy context. Using the data on foreign investment into China, this study explores whether foreign firms that are under greater environmental pressure, at home or at the host, outperform comparable local firms in an emerging host country. In making this comparison, we use propensity-score matching and a (...) difference-in-differences approach to handle the problem of endogeneity inherent in comparing the performances of foreign versus local firms. We find empirical support that foreign firms perform better than local firms when they are under high environmental pressure in the emerging host country, and this result is driven by the foreign firms originating from countries with high environmental pressure. Despite many attempts to achieve an adequate definition of living systems by means of a set of necessary and sufficient conditions, the opinion that such an enterprise is inexorably destined to fail is increasingly gaining support. However, we believe options do not just come down to either having faith in a future success or endorsing skepticism. In this paper, we aim to redirect the discussion of the problem by shifting the focus of attention from strict definitions towards a philosophical framework (...) that allows conceiving of living systems as a natural kind, but whereby natural kinds are not to be defined by fixed necessary and sufficient conditions. We argue for a property-cluster kind approach according to which living systems constitute a natural kind with vague boundaries, capable of changing, and whose members do not need to instantiate every property. We draw from Boyd’s homeostatic property-cluster theory and introduce two modifications, one regarding homeostatic mechanisms and another related to the scientific role of kinds. Thus, our view overcomes some difficulties of Boyd’s theory and we are able to account for the natural kindhood of living things. We also emphasize the most appealing features of our approach for specific research fields and address three objections to this sort of approach. (shrink)

The aim of this article is to discuss how the increasing social control of violence and aggression, which characterized the period from the Archaic to the Classical Age in ancient Greece, can be explained as an Eliasian civilizing process. Particularly crucial for this development is the question of how the city-state’s distinctive urban-political structures were the locus of this civilizing process. Accordingly, it is argued that not only are Elias’s key concepts analytically relevant to the ancient Greek civilizing process, but (...) also that they are to be reassessed in the light of the ancient Greek city-state culture. Thus, by the advancing of the argument that the civilizing process is not a uniquely western phenomenon, which occurred in western Europe from the Middle Ages to the end of the 19th century, the analytical relevance of Elias is re-evaluated and augmented. Bringing together powerful new tools from set theory and the philosophy of language, this book proposes a solution to one of the few unresolved paradoxes from antiquity, the Paradox of the Liar. Treating truth as a property of propositions, not sentences, the authors model two distinct conceptions of propositions: one based on the standard notion used by Bertrand Russell, among others, and the other based on J.L. Austin's work on truth. Comparing these two accounts, the authors show that while the (...) Russellian conception of the relation between sentences, propositions, and truth is crucially flawed in limiting cases, the Austinian perspective has fruitful applications to the analysis of semantic paradox. In the course of their study of a language admitting circular reference and containing its own truth predicate, Barwise and Etchemendy also develop a wide range of model-theoretic techniques--based on a new set-theoretic tool, Peter Aczel's theory of hypersets--that open up new avenues in logical and formal semantics. The United States Fish and Wildlife Service in Alaska, USA, conducted a species status assessment for a petition to list the Alexander Archipelago wolf (Canis lupus ligoni) under the Endangered Species Act in 2020-2022. This federal undertaking could not be adequately prepared without including the knowledge of Indigenous People who have a deep cultural connection with the subspecies. Our objective is to communicate the authoritative expertise and voice of the Indigenous People who partnered on the project by demonstrating how their (...) knowledge contributed to the species status assessment. The Indigenous knowledge applied in the assessment is the cultural and intellectual property of those who have shared it. We employed rapid appraisal research to expeditiously develop a preliminary and qualitative understanding of Indigenous People's cultural and ecological knowledge of Alexander Archipelago wolves. We used semi-directed interviewing and inductive coding from grounded theory for text analysis. Indigenous knowledge contributed to the agency's understanding of the Alexander Archipelago wolf in Southeast Alaska and helped the agency with their classification decision. Indigenous research partners explained the rich cultural significance and position of wolves in Tlingit society and described human–wolf relationships and ecological interactions. The agency used a single-species assessment approach based in species ecology and conservation biology, whereas the Indigenous wolf experts applied a multi-species, community ecology approach based in a sociocultural context of balance and respect. The Indigenous wolf experts successfully addressed knowledge gaps identified by the agency. The partners were challenged by a short regulatory timeframe that did not allow for comprehensive study of Indigenous knowledge and constrained review and feedback by Indigenous experts. The United States Fish and Wildlife Service learned that its assessment framework was not designed to account for an Indigenous worldview. To level the playing field, the agency and Indigenous experts should discuss how to co-develop an assessment framework that equitably applies both perspectives. (shrink)

An exploratory model is presented as a heuristic to indicate how individual perceptions of corporate reputation (before joining) and corporate ethical values (after joining) generate specific individual organizational senses of fit. The paper suggests that an ethical dimension of person-organization fit may go some way in explaining superior acquisition and retention of staff by those who are attracted to specific organizations by levels of corporate social performance consonant with their ethical expectations, or who remain with them by virtue of better (...) personal ethical fits with extant organizational ethical values. Specifically, the model suggests that individual misfits that arise from ethical expectations that either exceed or fall short of perceived organizational ethical performances lead to problematic acquisition and retention behavioural outcomes. How do humans discover causal relations when the effect is not immediately observable? Previous experiments have uniformly demonstrated detrimental effects of outcome delays on causal induction. These findings seem to conflict with everyday causal cognition, where humans can apparently identify long-term causal relations with relative ease. Three experiments investigated whether the influence of delay on adult human causal judgements is mediated by experimentally induced assumptions about the timeframe of the causal relation in question, as suggested by Einhorn and Hogarth (1986). (...) Causal judgements generally decreased when a delay separated cause and effect. This decrease was less pronounced when the thematic context of the causal relation induced participants to expect a delay. Experiment 3 ruled out an alternative explanation of the effect based on variations of cue and outcome saliencies, and showed that detrimental effects of delay are reduced even more when instructions explicitly mentioned the timeframe of the causal relation in question. Knowledge thus mediates the impact of delay on human causal judgement. Implications for contemporary theories of human causal induction are discussed. (shrink)

Law plays a critical role in all stages of a public health emergency, including planning, response, and recovery. Public health emergencies introduce health concerns at the population level through, for example, the emergence of a novel infectious disease. In the United States, at the federal, state, and local levels, laws provide an infrastructure for public health emergency preparedness and response efforts: they grant the government the ability to officially declare an emergency, authorize responders to act, and facilitate interjurisdictional coordination. Law (...) is perhaps most visible during an emergency when the president or a state's governor issues a disaster declaration establishing the temporal and geographic parameters for the response and making financial and other resources available. The desire for parsimony – to posit as few explanatory features as possible – has a rich philosophical history and is often given lots of weight in philosophical theory construction. But, as the psychologist Tania Lombrozo has demonstrated, our bias in favour of parsimony can lead us to adopt simple explanations even when it’s far more likely that a complicated explanation is correct.

When a disaster occurs, adults over age 65 may be disproportionately impacted due to sensory deficits, chronic health conditions, diminished social support and isolation, and financial limitations. Although older adults comprised approximately 15 percent of the New Orleans population, they accounted for over 70 percent of the fatalities associated with Hurricane Katrina in 2005. Disasters can also impact older adults’ morbidity, as a disaster may disrupt established habits and routines and result in removal from a familiar environment, promoting disorientation. This (...) may raise particular challenges for older adults with mental and physical co-morbidities, and subsequently for their formal and informal caregivers.While some older adults may need care for physical health problems following a disaster, mental health needs are often overlooked or unmet. One study of Hurricane Katrina survivors found that, compared to older adults, middle-aged individuals were twice as likely to have received mental health services in the eight months after the hurricane. Professor J. L. Austin published only reluctantly during his life time so that we are getting much of his major work after his death. I think this an enormous pity as there would be much to be learned from his answers to the criticisms which have already been given to his books by critical reviewers. I differ from many of the reviewers in that I think How To Do Things With Words is one of the most important books, if not (...) the most important, to come out since Wittgenstein's Philosophical Investigations. Like the Investigations, to a superficial glance it exists in isolation. That is, in it there is little discussion of current or traditional philosophical problems and the application of what is said to these problems is a matter, in large part, for the reader. The book itself consists in a set of relatively simple sentences, almost all of them about some aspect of the English language; it therefore represents not so much a problem of interpretation as the problem of which way up we shall look at it. The obvious way to look at it, the way Austin explicitly offers us, is as the Pursuit of the Performative. For reasons I shall give later, I do not think this is the best way to look at it but it is the way with which I shall start. (shrink)

One of the problems which surfaces in philosophical literature as regularly as clockwork is the status of tensed and tenseless discourse. This received its most influential formulation in McTaggart The Nature of Existence. Two philosophers who respond to McTaggart are Hans Reichenbach and J.J.C. Smart. In this paper, I review their analysis of token-reflexive terms. First, I examine Reichenbach’s arguments for translating tensed discourse into tenseless discourse. In order to show its subtlety, I also discuss Smart’s attempt to provide such (...) translations. This analysis is adequate for a limited number of tenseless utterances. Yet even Reichenbach’s analysis fails in certain important instances. That this attempt fails is a strong argument for supposing that any other such attempt will fail as well. If correct, it should put to rest the philosophically tempting quest for a tenseless discourse. (shrink)
